Under the new Care Act, wherever there is an appearance of care and support needs from any individual, the local authority has a legal duty to carry out an assessment of those needs which promotes that person’s individual sense of wellbeing. If it is then identified that you are not able to fully understand or participate in this process and you have no suitable person to support you in making your views and wishes known, the local authority has a further legal duty to provide you with an Independent Advocate.
