If you die without making a will, you are said to have died ‘intestate’. In this situation, your estate is divided up according to the statutory rules of intestacy, which may not reflect your wishes. Your assets are distributed after all debts, funeral and administration expenses, and any taxes have been paid. 

One of the most common issues is that unmarried partners or those who have not registered in a civil partnership cannot inherit from each other unless there is a will in place that states otherwise. To add to this, if there are no surviving relatives who can inherit under the rules of intestacy, the estate passes to the Crown. This means that the inheritance left from the deceased will go to the government rather than to a loved one or to a charitable cause.
